Meow Habit Terms of Use
These Terms of Use ("Terms") govern your use of the Meow Habit (喵喵打卡) iOS application (the "App") provided by 深圳市壹心互娱科技有限公司 ("Oneheart," "we," "us," or "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility and Apple terms
You must be legally capable of accepting these Terms. If you are a minor where you live, a parent or legal guardian must review and agree to these Terms on your behalf.
Your license to the App is also subject to Apple's applicable App Store and Apple Media Services terms. Unless a custom end-user license agreement is presented through the App Store, Apple's Standard Licensed Application End User License Agreement applies and is incorporated into these Terms. If these Terms conflict with mandatory Apple terms, the mandatory Apple terms control.
2. The service
The App lets you create and organize habits, record completions, schedule local reminders, review calendar and year views, and use other habit-tracking features made available in the current version. The App does not require a Oneheart account. iCloud sync requires an eligible Apple Account and depends on Apple's services and your device settings.
You are responsible for the habit goals, schedules, reminders, and content you create, and for deciding whether they are appropriate for you. Do not rely on the App for emergencies, medication adherence, medical treatment, or any activity where a missed or inaccurate reminder could cause harm.
3. Free and paid features
The free version allows up to three habits. Paid access may include unlimited habits, recovery of soft-deleted habits, longest-streak information, global data overviews, advanced trends, and other features identified on the purchase screen. Monthly and annual subscriptions and a one-time lifetime purchase unlock the same currently available paid feature set unless the purchase screen clearly states otherwise.
Existing habit records remain viewable if a subscription expires. If you then have more habits than the free limit, you may continue to view and record completions for existing habits but may be unable to create additional habits until you reduce the count or regain paid access.
4. Subscriptions, trial, billing, and restoration
- Prices and available products are shown in the App Store purchase interface and may vary by country or region.
- Payment is charged to your Apple Account when you confirm a purchase.
- Monthly and annual subscriptions automatically renew unless you cancel at least 24 hours before the end of the current subscription period. Apple may charge your account for renewal within 24 hours before that period ends.
- The annual plan includes a seven-day free trial where displayed. Unless you cancel at least 24 hours before the trial ends, it converts to a paid annual subscription. Any unused portion of a free trial may be forfeited when you purchase a subscription, as permitted by Apple policy.
- You can manage or cancel subscriptions in your Apple Account subscription settings. Deleting the App does not cancel a subscription.
- The lifetime option is a one-time, non-renewing purchase associated with the Apple Account used for purchase.
- Use "Restore Purchases" in the App to restore eligible access. Restoration depends on Apple transaction records and the availability of App Store services.
- Refund requests and billing disputes are handled by Apple under its policies and applicable law.
5. Your data and content
Your habit data is stored locally and, when available, in your private iCloud database. You are responsible for maintaining access to your device and Apple Account and for making any backups you consider necessary. Sync timing and availability may vary due to network conditions, device settings, storage limits, or Apple service availability.
If you submit feedback, you grant Oneheart a non-exclusive, worldwide, royalty-free license to use the submitted message, screenshot, and related information only as reasonably necessary to provide support, investigate issues, improve the App, and protect our legal rights. You represent that you have the right to submit that material and that it does not unlawfully disclose another person's information or infringe third-party rights.
Our handling of information is described in the Meow Habit Privacy Policy.
6. Acceptable use
You may not:
- use the App in violation of applicable law or another person's rights;
- attempt to gain unauthorized access to the App, CloudKit records, systems, or networks;
- interfere with security, availability, or normal operation of the App or related services;
- reverse engineer, decompile, disassemble, modify, or create derivative works from the App except where applicable law expressly permits it; or
- submit malicious code, unlawful material, abusive content, or another person's confidential information through the feedback service.
7. Intellectual property
The App, including its software, text, interface, illustrations, icons, mascot, sounds, trademarks, and other content provided by Oneheart or its licensors, is protected by intellectual-property laws. Subject to these Terms and Apple's Usage Rules, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use the App on Apple-branded products you own or control for personal, non-commercial purposes.
8. Changes and availability
We may update, add, change, suspend, or discontinue features to maintain security, comply with law, respond to platform changes, or improve the App. We will not intentionally deprive you of paid access in violation of applicable law. Some functions, including iCloud sync, feedback, purchases, and notifications, depend on Apple services that we do not control.
9. Disclaimer
To the maximum extent permitted by applicable law, the App is provided "as is" and "as available." We do not warrant that the App will be uninterrupted, error-free, or suitable for every goal or purpose. Habit statistics and reminders may be affected by user input, device time and time-zone settings, notification permissions, sync delays, software updates, or service availability.
Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded.
10. Limitation of liability
To the maximum extent permitted by applicable law, Oneheart and its affiliates, officers, employees, and licensors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or opportunities arising from use of or inability to use the App. This limitation does not apply where liability cannot be limited by law, including liability caused by fraud, willful misconduct, or other non-excludable conduct.
11. Suspension and termination
You may stop using the App at any time. We may restrict access to related services if you materially violate these Terms or if necessary to protect users, systems, legal rights, or service integrity. Provisions that by their nature should survive termination—including intellectual property, disclaimers, liability limits, dispute terms, and payment obligations—will survive.
12. Governing law and disputes
These Terms are governed by the laws of the People's Republic of China, excluding conflict-of-law rules. The parties should first attempt to resolve disputes through good-faith consultation. Where permitted by applicable law, unresolved disputes may be submitted to a court with jurisdiction in Bao'an District, Shenzhen, China.
If mandatory consumer law in your country or region gives you protections or a forum that cannot be waived, those protections and that forum remain available to you.
13. Changes to these Terms
We may update these Terms to reflect changes in the App, law, or our operations. We will post the revised Terms with an updated date and provide additional notice where required. Your continued use after the effective date means you accept the revised Terms, except where the law requires a different form of consent.
